Welcome to the Class Living website by Class Living Pte Ltd (“the Website”). We offer our products and services to you based on these Terms and Conditions. By using our Website, you are deemed to have accepted these Terms and Conditions. If you do not agree to be bound by these Terms and Conditions, you may not use our Website in any way. Should these Terms and Conditions conflict with any other documents, the Terms and Conditions will prevail for the purposes of usage of our Website.

We reserve the right to update or revise the Terms and Conditions at our sole discretion from time to time. The updated Terms and Conditions will be posted on the Website and shall take effect from the indicated date of posting. The continued use of this Website following the posting of any revisions to the Terms and Conditions constitutes acceptance of those revisions.

Customers or visitors to this Website shall herein be referred to as “You” or “Your”. Class Living Pte Ltd shall herein be referred to as “Us”, “Our” or “We”.

OUR SERVICES

Class Living Pte Ltd provides you access to purchase products and services online, which may be revised from time to time. Access to the Website may involve third-party fees (such as Internet service provider or airtime charges). In addition, you must provide and be responsible for all equipment necessary to access the Website.

ELIGIBILITY

The services on our Website are not available to minors under the age of 18 or to any users suspended or removed by us for any reason. By purchasing our products and/or services, you represent that you are of legal age. We may sell products for children, but we sells them to adults, who can purchase with a credit card or interbank transfer. If you do not qualify, you may not use the Website. Class Living Pte Ltd reserves the right to refuse service, remove or edit content, or cancel orders at our sole discretion.

In order to place an order on our Website, users will be required to register an account with us with a unique username and password. Additionally, users are prohibited from selling, trading or otherwise transferring their account to another party. Membership is void where prohibited by law.

USE OF THE WEBSITE & PRODUCTS

The inclusion of any products or services on this Website at a particular time does not guarantee that the products or services will be available. We reserve the right to adjust and/or restrict the amount of information that you are entitled to view on the Website.

All content included on this Website, such as text, graphics, logos, button icons, images, audio/video clips, digital downloads, data compilations, and software, is the property of Class Living Pte Ltd and/or its content suppliers and is protected by Singapore and international copyright laws and/or other laws. The compilation of all content on this Website is the exclusive property of Class Living Pte Ltd and is protected by Singapore and international copyright laws and/or other laws. None of the content may be copied, reproduced, retransmitted, distributed, disseminated, sold, published, broadcasted or circulated whether in whole or in part, unless expressly permitted by us and/or our suppliers, as the case may be.

Nothing contained on the Website should be construed as granting by implication, estoppel, or otherwise, any licence or right to use any trademark displayed on the Website without our written permission. Misuse of any trademarks or any other content displayed on the Website is prohibited.

We will not hesitate to take legal action against any unauthorised use of any trademarks, name or symbols displayed on the Website to preserve and protect the rights in them. All rights not expressly granted herein are reserved. Other product and company names mentioned herein may also be the trademarks of their respective owners (see Original / Licensed Fabrics below).

PAYMENTS

Payment is only accepted via credit card. Goods will not be dispatched until full payment is received by us. We do not retain any payment information or card details. We are not responsible for any charges incurred by you from your credit card company or bank in relation to the processing of any order made with us. Please note that if, for any reason, your card payment is not authorized by your bank/credit card company, we will not be able to proceed with your order and it will be cancelled.

In a credit card transaction, you must use your own credit card. Class Living Pte Ltd is not liable for any credit card fraud. The liability for any fraudulent use of a credit card will be on the user and the onus to prove otherwise shall be exclusively on the user.

DELIVERY AND CHARGES

All items will be couriered to one (1) local Singapore address as stated in your order. For unsuccessful delivery to your address as stated, the package will be returned to us. Your order may be re-processed upon request subject to an administrative fee of SGD2.00 as well as any courier charges. Class Living Pte Ltd reserves the right to refuse delivery if any amount owing to us is not paid in full or if there are any other reasons preventing us from carrying out the delivery. The risk of loss lies with you during the course of the delivery of the items.

We reserve the right to refuse orders which we find to be offensive, defamatory, obscene or in violation of any third party’s intellectual property or other rights.

TURNAROUND TIME

As our products are either made to order or produced by artist/artisan, we aim to turn around your orders within 2 to 4 weeks of receipt of the order. However, if this is not possible, we will notify you via email.

TERMINATION

Class Living Pte Ltd reserves the right to terminate the services or part thereof, with or without cause at any time. We shall not be liable for any damages, losses, cost or expenses howsoever caused by arising out of termination of any part of the services, to you or any other individual.

This termination may apply to the voiding of the sale of all products on Class Living Pte Ltd, regardless of whether payment has been made (in which case the payment shall be refunded to the customer or the issue resolved on a case-by-case basis). The cancelling, blocking or denying of a sale or purchase can be effectuated in the event of suspected fraud, hacking or technical or server complications.

You may not create a link to any page of the Website without our prior written consent. If you do create a link to a page of the Website, you do so at your own risk and the exclusions and limitations set out herein will apply to your use of the Website by linking to it.

Class Living Pte Ltd shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or inability to use the services or messages received or transactions entered into through the services or resulting from unauthorized access to our alteration or disclosure of your transmissions or data including any information on your bills, emails, statements and other documents as displayed on the website, including but limited to, damages for loss of profits, use, data or other intangibles, even if we have been advised of the possibility of such damages.

Class Living Pte Ltd shall not be liable for any failure to perform any of our obligations under these Terms and Conditions if such failure is the result of circumstances outside our control including but not limited to the outbreak of war, any governmental act, explosion, accident, civil commotion, riot, industrial dispute, strike, lockout, stoppages or restraint of labour from whatever cause, whether partial or general, weather conditions, traffic congestion, mechanical breakdown, obstruction of any public or private road or highway or any other force majeure, fire, flood or any other act of God.

The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer that cannot be excluded or limited are affected.

Notwithstanding our efforts to ensure that our system is secure, you acknowledge that all electronic data transfers are potentially susceptible to interception by others. We cannot, and do not, warrant that data transfers pursuant to this Website, or electronic mail transmitted to and from us, will not be monitored or read by others.

SOFTWARE

Although we use reasonable endeavours to ensure that any software made available on this Website is suitable for downloading, installation and use by third parties, all such software is provided “as is” without any warranty. PRODUCTS

All products sold via Class Living Pte Ltd are on an ‘as-is’ basis and we make no warranties of merchantability, quality, fitness for a particular purpose, availability or non-infringement and we disclaim all implied warranties from course of dealing or usage of trade.

Due to the customised and handmade nature of majority of our products, please expect variation in colour, texture, weight, design, size or packaging between products and images found on our Website. However, we endeavour to maintain as much consistency as reasonably possible.

INTERNATIONAL USE

We make no representation that information on this Website is appropriate or available for use outside Singapore. Those who choose to access this Website from outside Singapore do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.

INDEMNITY

By using this Website, you agree to indemnify and hold Class Living Pte Ltd (and its officers, directors, employees, agents, subsidiaries, affiliates and joint ventures) (each an “Indemnified Person”) harmless from any claim or demand, action, suit or proceeding brought or threatened to be brought against any Indemnified Person which is caused by or arising out of (i) your access and/or use of the Website, and/or (ii) your breach of any of these Terms and Conditions , and to pay such Indemnified Person damages, costs and interest in connection with such claim, demand, action, suit or proceeding.

NO RETURN POLICY

All products are carefully checked, packed and in good order before delivery. As majority of our products are handmade by artists/artisans, hence, they are unique and of very limited quality. As such, all products sold are non-exchangeable nor refundable.

PRIVACY POLICY

We do not sell or pass on any of our customers’ information, i.e. name, address, email address etc to any other parties. We reserve the right to contact you regarding your order and, on occasion, may email you about our products. If you do not wish to receive any promotional material from us, please contact us at enquiry@classliving.com.sg and we will remove your details from our mailing list.

LAW AND JURISDICTION

This Agreement shall be governed by and interpreted and construed in accordance with the laws of Singapore and the Court of Singapore shall have jurisdiction.’

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement and understanding between the Parties in connection with the subject matter of this Agreement and supersedes all previous proposals, representations, warranties, agreements or undertakings relating thereto whether oral, written or otherwise and neither Party has relied on any such proposals, representations, warranties, agreements or undertakings.
